Public Offer Agreement

1. General provisions and acceptance

This document is an official public offer by Individual Entrepreneur (FOP) Vitalij Oleksandrovych Dubenyuk (the “Provider”) to enter into a services agreement on the terms below, addressed to any individual who accepts it (the “Client”), pursuant to Articles 633 and 641 of the Civil Code of Ukraine.

Acceptance of this offer is made by paying for the service on the Level Signal website. Acceptance constitutes full and unconditional agreement with all terms of this agreement, the Privacy Policy, and the Refund Policy, which are integral parts of this agreement.

By accepting this offer, the Client confirms that they are at least 18 years old and have full legal capacity, expressly requests that the Provider begin performance immediately upon payment, and acknowledges that once access to the digital report is granted, the service is deemed fully rendered and any statutory right of withdrawal or cancellation is lost to the maximum extent permitted by applicable law.

2. Subject of the agreement

The Provider renders an information service: an online assessment of the Client's engineering competencies followed by an automatically generated career report (current level estimate, promotion readiness, career blockers, development recommendations).

The assessment questions and the generated report are provided in English. The website interface is available in Ukrainian and English.

The report is generated by a deterministic algorithm based solely on the answers the Client provides during the assessment. The quality and accuracy of the results therefore depend entirely on the completeness and accuracy of the Client's own answers.

3. Informational nature of the service; no professional advice

The report and all related content are provided for informational and educational purposes only. They do not constitute professional, legal, HR, employment, financial, psychological, or any other regulated advice, and are not a certification, qualification, or formal evaluation of the Client.

The Provider does not warrant or guarantee the accuracy of any level estimate, benchmark, or recommendation, and does not guarantee employment, promotion, salary changes, or any other career or life outcome. The Client uses the report at their own discretion and risk, and remains solely responsible for any decision they make.

4. Price and payment

The price of the full report is ₴3 299 (Ukrainian hryvnia, UAH). The current price is always displayed on the website before payment.

Payment is made online by card on a 100% prepayment basis via the payment acquiring service. All charges are made in UAH. If the Client's card is issued in another currency, the Client's bank converts the amount at its own exchange rate and may apply its own fees; the final amount in the Client's local currency may differ from any approximate equivalent displayed on the website, and such differences are not refundable or compensable.

The service is deemed rendered in full once access to the report is granted to the Client.

5. Service delivery

Report access is granted automatically after successful payment, to the email address / account provided by the Client during the assessment.

If the report is not available within 24 hours of successful payment, the Client should contact support@levelsignal.dev; the Provider will grant access or refund the payment in full.

6. No warranties

To the maximum extent permitted by applicable law, the service and the website are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Provider does not warrant that the website will operate uninterrupted or error-free.

Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions the above exclusions apply to the maximum extent permitted by the applicable mandatory law.

7. Intellectual property and permitted use

All content of the website and the assessment (questions, methodology, frameworks, texts, design, software) is the intellectual property of the Provider or its licensors and is protected by law.

The Client receives a non-exclusive, non-transferable right to use the generated report for personal, non-commercial purposes. Copying, publishing, reselling, or distributing the assessment questions, methodology, or the report (other than sharing the Client's own report for personal career purposes), as well as any automated access, scraping, or attempts to reverse-engineer the scoring algorithm, is prohibited.

8. Client obligations

The Client undertakes to provide accurate information during the assessment, to use the service in good faith and only for its intended purpose, not to attempt to manipulate or game the assessment, and not to transfer paid access to third parties.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Provider's aggregate liability under or in connection with this agreement is limited to the amount actually paid by the Client for the service.

To the maximum extent permitted by applicable law, the Provider is not liable for any indirect, incidental, special, or consequential damages, lost profits, lost opportunities, or moral damages; for decisions made by the Client or any third party (including employers) on the basis of the report; or for failures of third-party services (payment provider, hosting, email delivery) outside the Provider's reasonable control.

Nothing in this agreement excludes or limits liability that cannot be excluded or limited under applicable mandatory law.

10. Refunds

Refund terms are set out in the Refund Policy, which is an integral part of this agreement. The report is digital content delivered immediately; except for the cases expressly listed in the Refund Policy or required by applicable mandatory law, payments are non-refundable once report access has been granted.

11. Personal data

The Provider processes the Client's personal data in accordance with the Privacy Policy and the Law of Ukraine “On Personal Data Protection”, as well as other data protection laws applicable to the Client.

12. Force majeure

The Provider is released from liability for full or partial non-performance of this agreement caused by circumstances beyond its reasonable control (force majeure), including natural disasters, war and military actions, acts of public authorities, power or internet outages, and failures of telecommunication networks, for the duration of such circumstances.

13. Term and changes

This agreement takes effect upon acceptance and remains in force until the parties have fully performed their obligations.

The Provider may amend this offer, the service, and prices at any time by publishing the updated version on the website. The version in force at the moment of the Client's payment applies to that purchase.

14. Governing law and disputes

This agreement is governed by the substantive law of Ukraine. The parties shall first attempt to resolve any dispute through negotiations via support@levelsignal.dev within 30 days; failing that, the dispute is submitted to the competent court of Ukraine.

If the Client is a consumer in a jurisdiction whose mandatory consumer-protection law grants rights or a forum that cannot be waived by agreement, nothing in this agreement deprives the Client of such rights or forum.

If any provision of this agreement is held invalid or unenforceable, the remaining provisions remain in full force. This agreement, together with the Privacy Policy and the Refund Policy, constitutes the entire agreement between the parties regarding the service.
